For its part, EPA is withdrawing the Clean Air Act preemption waiver it granted to the State of California in January 2013 as it relates to California’s GHG and ZEV programs. EPA said that the legal basis for withdrawing the California waiver is under CAA section 209(b)(1)(B), which covers compelling and extraordinary conditions.

The petition challenges the ability of EPA to grant a partial waiver for three specific reasons: The Clean Air Act does not authorize EPA to issue any partial waiver decisions.
