17 States have filed a lawsuit with the Federal Court of Appeals, suing to prevent California from banning new ICE vehicle sales after 2035. California’s Air Resources Board (CARB) is expected to ban the sale of new ICE vehicles after 2035 tomorrow, but 17 State Attorney Generals have sued in federal court to block the move.

Yet, E-15 has been shown to adversely affect engines in non-road products and later model year vehicles, cause emission failures and increase air pollution due to misfueling, the group says. The RFA will continue to press for the safe and effective use of higher level ethanol blends in both conventional as well as flexible fuel vehicles.

The lawsuit follows an ongoing legal challenge by the same organizations of EPA’s 13 Oct 2010 decision to allow the use of E15 in vehicles model year 2007 and newer. EPA’s 21 Jan decision raised the amount of ethanol permitted in gasoline used by cars and light trucks for model years 2001-2006 from 10 percent (E10) to 15 percent (E15).

Breyer of the United States District Court for the Northern District of California has granted preliminary approval of the settlement agreement reached on 28 June with private plaintiffs represented by the Plaintiffs’ Steering Committee (PSC) to resolve civil claims regarding eligible Volkswagen and Audi 2.0L TDI vehicles.

The US Environmental Agency (EPA) has granted California’s waiver request enabling the state to enforce its greenhouse gas emissions standards (Pavley I) for new motor vehicles, beginning with the current model year.
