EPA issued a second notice of violation ( NOV ) of the Clean Air Act (CAA) to Volkswagen AG, Audi AG and Volkswagen Group of America, Inc., liter engines for model years (MY) 2014 through 2016 that results in increased NO x emissions of up to nine times EPA’s standard. In addition, the NOV covers an unknown volume of 2016 vehicles.

The NO 2 plan is one element in the Government’s efforts to deliver clean air. In 2018, the Government will publish a comprehensive Clean Air Strategy which will address other sources of air pollution. The alleged violations do not present a safety hazard; the cars remain legal to drive and resell. The software produced by Volkswagen is a “defeat device,” as defined by the Clean Air Act.

The Q7 PHEV will arrive in dealerships in Germany in 2016, and will likely come to the US, although perhaps with a gasoline-engine variant. Because the exhaust system transports only water, it can be made of lightweight polymer. The actual bursting pressure is much higher still and far exceeds the legal requirements.
