The US Court of Appeals for the District of Columbia Circuit rejected a petition (Case Nº 10-1107) by the National Chicken Council, National Meat Association, and National Turkey Federation challenging the Environmental Protection Agency’s (EPA) rulemaking on the RFS2. EISA directed EPA to promulgate regulations.

For those that don’t recall this particular saga of the Great American Gas War, the EPA reinstated a waiver under the Clear Air Act that allowed California to establish vehicle emission rules that went beyond federal standards in 2022. On Tuesday, a U.S. Joe Biden ultimately restored the waiver by executive order after taking office.
