As of October 1, 2023, every US state except Michigan, Nebraska, Tennessee, and Wisconsin has passed the legislation needed to redefine a utility and allow kWh pricing. kWh tax in January 2024, with an exemption for chargers with less than 50kW capacity (Level 2 chargers range from 7.2-19.2kW, 19.2kW, and DCFC begin at 30kW).
