The Supreme Court of the US has denied review of the Ninth Circuit Court of Appeals’s 2011 decision (Case (09-17765) in Pacific Merchant Shipping Assn. Given the circumstances, we do believe that the regulatory scheme at issue here pushes a state’s legal authority to its very limits, although the state had clear justifications for doing so.
