The Virginia State Corporation Commission may not set the rates, charges, or fees for retail EV charging services provided by non-utilities. Owners of EV charging stations must register for a business license and are responsible for reporting and remitting a tax of $0.026 per kWh dispensed into an EV battery or energy storage device.
