The Diesel Emissions Reduction Act (DERA) grant program was authorized as part of the Energy Policy Act of 2005 to fund retrofits and replacements of the oldest, most polluting diesel engines, complementing the stringent emissions standards on new diesel engines that EPA promulgated in 2007.

The waiver request was made by California on 21 December 2005, to allow the state the right to control greenhouse gas emissions from motor vehicles. The request was denied by then-EPA Administrator Stephen Johnson on 6 March 2008. On 26 January 2009, President Barack Obama requested that EPA revisit the matter of the denial.
