These credits can be used to offset emissions from less fuel-efficient vehicle models or sold or traded to other automakers for the same purpose. The consent decree embodying the settlement was filed today jointly by the United States and the California Air Resources Board in the US District Court for the District of Columbia.

This waiver is consistent with the Clean Air Act as it’s been used for the last 40 years and supports the prerogatives of the 13 states and the District of Columbia who have opted to follow California’s lead. The resulting new national standards will cover model years 2012-2016, and will require an average fuel economy standard of 35.5
