The Governors of California, Oregon and Washington and the Premier of British Columbia signed a regional agreement strategically to align policies to reduce greenhouse gases and promote clean energy. The agreement has no legal effect and imposes no legally binding obligation.

A judgement hearing has been set for 2 October to deal with issues arising out of this decision, including relief from infringement, damages to Velocys, and reimbursement of Velocys'' legal costs. Led by the State of New York, the coalition also includes California, Connecticut, Delaware, Maryland, Massachusetts, New Mexico, Oregon, Rhode Island, Vermont and Washington. The EPA has not taken action in response to the coalition's notice, leading Schneiderman and his coalition to take the latest legal action.

The US Environmental Protection Agency’s (EPA) decision to grant California’s request to carry out its own clean car standards not only clears the way for the Schwarzenegger-led state to cut its own greenhouse gas emissions, but it is likely to effect at least 13 additional states too.

This previous decision was based on an interpretation of the Clean Air Act finding that California did not have a need for its greenhouse gas emission standards to meet “ compelling and extraordinary conditions. ” ( Earlier post.). California requested from EPA the waiver required for implementation of the Pavley regulations in December 2005.

Navigant’s analysis indicates that only buyers in California and Oregon will purchase sufficient numbers of vehicles in order to meet the ZEV requirement in 2018 and 2019. Included in the frenzy will be contrived “battery electric vehicle (BEV) versus FCV” debates in the media and among clean fuel vehicle advocates.

The strategy will guide the current 2007-2012 offshore oil and gas leasing program, which was written by the previous administration but found by the courts last year to be legally flawed, as well as the new 2012-2017 program that this administration will propose. To fail to recognize this reality would be a mistake.
