Led by the State of New York, the coalition also includes California, Connecticut, Delaware, Maryland, Massachusetts, New Mexico, Oregon, Rhode Island, Vermont and Washington. The EPA has not taken action in response to the coalition's notice, leading Schneiderman and his coalition to take the latest legal action.

The US Environmental Protection Agency’s (EPA) decision to grant California’s request to carry out its own clean car standards not only clears the way for the Schwarzenegger-led state to cut its own greenhouse gas emissions, but it is likely to effect at least 13 additional states too.

This previous decision was based on an interpretation of the Clean Air Act finding that California did not have a need for its greenhouse gas emission standards to meet “ compelling and extraordinary conditions. ” ( Earlier post.). California requested from EPA the waiver required for implementation of the Pavley regulations in December 2005.
